The Pacific Alliance in Search of Financial Integration: So Close and Yet So Far

Abstract:
This paper develops an analysis of how macroeconomic convergence among Mexico, Colombia, Peru, and Chile has translated into a non-intentional institutional and similar constitutional order, in areas as important as fiscal and monetary stability. The current reality opens many possibilities for deep financial integration and regulatory cooperation. These aspects are not sufficiently reflected in the Treaty and the Additional Protocol.

In fact, these instruments have followed the standard practice of previous Free Trade Agreements (FTAs) under the NAFTA model on financial services treatment that does not fit adequately with the objective of creating a free trade zone based on the free movement of capital and financial services.

An example of this reality is the timid development of mutual recognition of financial service authorisations in FTAs in contrast to the technical agenda of future developments in the Pacific Alliance. In this context, this paper offers some specific proposals for the peculiar institutional construction of the Pacific Alliance and regulatory cooperation. The proposals are based on the soft law experience of partners and the levels of convergence already obtained. The paper also reviews eventual consistency problems between financial integration and other international commitments of partners.

The Pacific Alliance’s Future: Integration towards Productive Growth

Este reporte delinea las ventajas y los retos que la Alianza del Pacifico afronta en su camino hacia la integración económica. Más aún, destaca las oportunidades que el bloque comercial ofrece a las compañías privadas que pueden beneficiarse con la creación de este gran mercado y convertirse en uno de los impulsores de su éxito, en el caso que actúen decisivamente ahora.

Proyectamos que si la Alianza del Pacífico continúa sus esfuerzos de cooperación e integración, y toma los pasos correctos para mejorar la productividad, estará en posición de incrementar su actual promedio de crecimiento anual proyectado de 3.3 a 5.2% para 2035. Esto traerá vastos beneficios en términos de desarrollo humano y sustentabilidad donde la Alianza tiene metas ambiciosas. También ofrece oportunidades de negocios con posibilidades de amplio espectro dada la conexión de la Alianza con el mercado de Estados Unidos a través del Tratado de Libre Comercio de América del Norte (TLCAN), suscrito por México, y a la región Asia-Pacífico por medio del TPP, del cual México, Perú y Chile son signatarios.

Aunque el énfasis ha estado en la negociación de bienes, se estima que la región tiene un gran potencial en materia de exportación de servicios. Con base en los acuerdos y lineamientos ya contenidos en el Protocolo Adicional, se espera que los países precisen a corto plazo las reglas y criterios específicos para armonizar el tratamiento de ámbitos tan diversos como los servicios profesionales, los servicios de offshoring, los servicios de telecomunicaciones, los servicios de transporte, entre otros.

The Pacific Alliance Guide to the Most Important Latin American Trade Bloc You Likely Don’t Know

Abstract:
A significant step forward has been taken by the Member States when signing the Additional Protocol to the Framework Agreement, which entered into force on May 1, 2016. The agreement contains specific provisions with the aim to create a free-trade zone, through the inclusion of key matters such as an investment guarantee regime and dispute resolution mechanisms, market access, rules of origin, trade facilitation and customs cooperation, sanitary and phytosanitary measures, technical barriers to trade, government procurement, cross‑border trade in services, maritime transport, financial services, electronic commerce, telecommunications, institutional affairs, and dispute resolution.

This Additional Protocol builds on and expands existing bilateral trade agreements. The agreement reinforces liberalisation policies on goods, services, capitals, and people of the Pacific Alliance, and has achieved a 92% liberalisation on tariffs upon its entry into force. The remaining tariffs will be reduced in different periods between 3 and 17 years, except for agreed exceptions.
Likewise, the inclusion of a cumulation of origin mechanism will allow for production linkages in the region that will lead to the restructuring of productive systems in each country, where their individual industrial conditions will be favoured.

This Handbook offers a summary of the most relevant Chapters of the Additional Protocol to the Framework Agreement of the Pacific Alliance and the First Amendment Protocol to the Additional Protocol to the Framework Agreement of the Pacific Alliance, which we consider interesting and useful for our clients’ business.

Identification of Opportunities to Develop and Strengthen the Digital Agenda in the Pacific Alliance

Resumen:
Tras la revisión de los contenidos del Acuerdo Transpacífico de Cooperación Económica (TPP por sus siglas en inglés), del Foro de Cooperación Económica de Asia Pacífico (APEC), de la Organización Mundial del Comercio (OMC), el Acuerdo Económico y Comercial Global (AECG o CETA), Acuerdo sobre el Comercio de Servicios (ACS o TiSA) y las normativas de la Alianza del Pacífico, así como de las entrevistas con expertos tanto del sector público y privado, se concluye que el Protocolo Adicional de la Alianza del Pacífico (PAAM) contempla la mayoría de los temas necesarios para el impulso de la agenda digital. Sin embargo, aún se detectan áreas de oportunidad en las cuales se pueden profundizar con el propósito de asegurar de forma concreta la participación del bloque en el proceso global de digitalización.

En materia de comercio electrónico, uno de los elementos más pujantes de la economía digital, la Alianza del Pacífico debe promover la difusión de los respectivos marcos normativos que protegen a los consumidores en las transacciones realizadas dentro del bloque, junto con orientar sus esfuerzos en diseñar mecanismos y mejoras orientadas a proteger a los consumidores de posibles amenazas y fraudes online. A su vez, las economías de la AP deben sumarse al comercio sin papel, por ejemplo, a través la homologación de autenticación electrónica.
