The Pacific Alliance: Juridical Scrutiny of the Content of the Law of International Organisations

Abstract:
Much has been said about the Pacific Alliance. It is undoubtedly the most novel process of integration in which the Republic of Colombia has participated. Nevertheless, insufficient attention has been paid to its juridical nature under international law, with the proposition of elucidating the legal consequences which will derive from it. The article starts from the content of the Law of International Organisations and considers the practice of the Ministry of External Relations of the Republic of Colombia, carrying out an evaluation of the Pacific Alliance.

It examines what has been convened, to date, in treaties agreed to in their sphere -on par with the international instruments of soft law to today adopted- with the proposition of determining whether certain concurrent requisites necessary on order to comport with the juridical nature of an international organization are met. Later, it will refer to some international law consequences which emanate from the foregoing and in the Colombian internal juridical order, inter alia, incapacity to conclude treaties and the proscription of the power to mandate provisional application in the Republic of Colombia, respectively.

Resumen:
Mucho se ha dicho sobre la Alianza del Pacífico. Se trata, sin duda, del proceso de integración más novedoso en el que participa la República de Colombia. No obstante, atención insuficiente se ha dedicado al examen de su naturaleza jurídica bajo el derecho internacional, con el propósito de dilucidar las consecuencias legales que de allí se derivan.

Al tenor del derecho de las organizaciones internacionales y considerando la práctica del Ministerio de Relaciones Exteriores de la República de Colombia, el presente artículo efectuará una evaluación de la Alianza del Pacífico, examinando lo consignado en los tratados que, a la fecha, han sido concertados en su ámbito –a la par con los instrumentos internacionales de soft law a hoy adoptados– con el propósito de determinar si se surten los requisitos concurrentes que se precisan para comportar la naturaleza jurídica de una organización internacional. Con posterioridad, se referirán algunas de las consecuencias que emanan de lo anterior en el derecho internacional y en el ordenamiento jurídico interno colombiano, inter alia, la incapacidad jurídica para concertar tratados y la proscripción de la facultad para disponer su aplicación provisional en la República de Colombia, respectivamente.
